We reserve the right to update, change, or replace any part of these Terms and Conditions at any time. It is your responsibility to review these terms periodically. Your continued use of our services after any changes constitutes acceptance of those changes.


Digital Products, Subscriptions, and Memberships

1. Eligibility: You must be at least 18 years old to purchase digital products, subscribe, or participate in our offerings.

2. Purchases and Fees: Certain content and services, including digital products (such as Cover Your Ass(ets)™ Templates, Organizers, and guides), subscriptions, and memberships (such as Empowered Presence: The Respect Blueprint), require a paid purchase or subscription. By purchasing, you agree to pay all applicable fees.

3. Digital Products Policy: All sales of digital products are final once access has been granted or materials have been delivered, as we cannot revoke access to downloaded or viewed content.

You will receive immediate access to digital products upon purchase via email or download link.
It is your responsibility to ensure the product is right for you before completing your purchase.
If you experience technical issues accessing your purchase, please contact support@martinaoneal.com and we will resolve the issue.

4. Subscription and Membership Cancellation: You may cancel subscriptions or memberships at any time by following the instructions provided in your account settings or contacting us at support@martinaoneal.com.
Cancellations will take effect at the end of your current billing cycle. No partial refunds will be issued for unused time in a billing period.

5. Refund Policy:

Digital Products: Due to the immediate access nature of digital products, all sales are final once access is granted. Refunds will not be issued except in cases of technical failure on our part that prevents access to the product.

Subscriptions/Memberships: Refunds for subscription or membership fees are handled on a case-by-case basis and must be requested within 7 days of purchase. Contact support@martinaoneal.com for refund requests.
Services (Coaching, AMA, etc.): Services must be used within the stated timeframe. Unused services are non-refundable and non-transferable.

6. Chargebacks: Initiating a chargeback or payment dispute for a validly delivered digital product or service may result in suspension of your account and access to all Martina O'Neal offerings.

User Conduct

By engaging with our services, you agree NOT to:

* Use our platforms for unlawful purposes or to solicit others to perform unlawful acts.
* Violate any applicable laws, rules, or regulations.
* Infringe on our intellectual property rights or the rights of others.
* Submit false or misleading information.
* Harass, abuse, insult, harm, defame, or discriminate against others based on gender, race, age, or any other protected category.
* Upload or transmit harmful or malicious code, including viruses.
* Attempt to collect or track personal information without proper authorization.


Intellectual Property
All content provided through H.E.R. Haven and Empowered Presence, including text, graphics, logos, and course materials, is the intellectual property of our brand or its content suppliers. Reproduction, distribution, or unauthorized use is strictly prohibited.


Third-Party Links
Our platforms may include links to third-party websites or services. We do not control or endorse the content, privacy policies, or practices of these third-party entities. We are not responsible for any damages or losses resulting from your interaction with such sites.


Disclaimer of Warranties and Limitation of Liability

1. Warranties:
     * Our services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free services.

2. Limitation of Liability:
     * We are not liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of our services, including, but not
        limited to, data loss, service interruptions, or unauthorized access.

You agree to indemnify and hold harmless H.E.R. Haven, Empowered Presence, and their affiliates, officers, and employees from any claims, liabilities, damages, or expenses arising out of your breach of these Terms and Conditions.


Termination of Service
We reserve the right to terminate or suspend access to our services at our sole discretion without notice if you violate these terms. Provisions related to intellectual property, liability, indemnification, and governing law will survive termination.
